To
Sri Bhupendra Yadav ji , honble union minister of labour and employment .

Smt Neelam ShamiRao ,
honble chief provident fund commissioner , EPFO ,
New Delhi .

Sub: Request for grant of moderate liveable minimum pension and also simplification of process for on line option of higher pension with ease for the benefit of all EPS 95 pensioners scattered all over the country , many many of whom are almost Illiterate , uneducated and not high techy with inability of operating the online system.
Respected sir/madam ji ,

EPS 95 PENSION GROUP

The EPS 95 pensioners are all in anxiety and eagre with need to have the benefit of higher pension entitled with the online process .The last date for option of the same is nearing . But lakhs of pensioners are unable to understand the process interacting with each other for what to do with the technical problems being encountered in operating the system that need to be set it in order .

The last date is necessary to be extended for further more time as already requested by others .
The other side , the senior and very senior EPS 95 pensioners accounted of more than 30 lakhs or so what the EPFO know , being unbenefited of the higher pension with their insufficient pensionable service are looking towards the minimum liveable pension with inflation linked dearance relief to breath their life with happiness in their last phase of livelihood among their society of near and dear .
Day and night mobile calls go to each other enquiring whether any ray of hope is coming from the honble govt , EPFO authorities on grant of hike of minimum liveable pension .
The poor unsupportive pensioners have kept hope on the honble govt to get the justice .
Kindly let their hope not go in vain .
The pensioners are not asking any bonus , only liveable minimum pension and the pension on their last drawn actual wages as per the service with the contribution to the pension fund .
The decision lies with the honble govt and EPFO for grant of moderate liveable minimum pension .
Making delay and delay over the years on the decision of hike of minimum pension being demanded , is taking the lives of poor pensioners in all disgust .
Kindly let the assurances being given by the honble minister of labour and employment be fruitified understanding the genuine need of the pensioners for basic survival to be lived happily in remaining span of life .
The pensioners being benefited of higher pension with their pensionable service and wages have legitimate claim of their entitlement for higher pension on contribution exceeding the ceiling wages The regional provident fund commissioners are not guiding the hapeless EPS 95 pensioners and not making it clear in the matter .
As per the verdict of the honble supreme court dated 4th nov 2022 and the verdict dated 12th April 2023 of honble Kerala high court reiterating the amended provision through the circular dated 22-1-2019 of EPFO it is held that :
However, if an employer and employee have contributed
under the EPF Scheme, 1952 on wages higher than the statutory wage
limit, without joint option of employee & employer, and the EPF
Account of the concerned employee has been updated by the EPFO on
the basis of such contribution received, then by action of
employee, employer and EPFO, it can be inferred that joint option of the employee and employer has been
exercised and accepted by the EPFO.

With all this position , the EPS 95 pensioners appeal for grant of moderate liveable minimum pension with inflation linked dearance relief and ease the online process for higher pension as well in order that all the pensioners get the much needed financial releif to live their life with happiness what they have been striving for it over the years . With high regards ,

Sincerely your’s

ShamRao , national secretary
EPS 1995 pensioners coordination committee,
